Justice Department Releases Updated ADA Regulations and Standards

The Department of Justice issued updated regulations under the Americans with Disabilities Act (ADA) on July 26, the 20th anniversary of the law’s enactment. The rules supplement various requirements and implement new standards for the construction and alteration of facilities that are based on guidelines established by the Access Board. President Barack Obama announced the news at a White House ceremony celebrating the ADA’s anniversary.

Jackson, Mississippi, Agrees To Improvements In Its Bus System To Serve Riders With Disabilities

On March 30, 2010, the federal court in Jackson, Mississippi, entered a consent decree resolving a lawsuit filed against the City of Jackson and the Jackson Public Transportation System (JATRAN) in 2008 on behalf of individuals with disabilities. The Department had intervened in this class action lawsuit in 2009 alleging that the City had violated Title II of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act by failing to provide a level of public transportation services to users with disabilities that is comparable to the services provided to other individuals.

Board to Set Standards for Medical Diagnostic Equipment

The healthcare reform measure recently passed by Congress and signed into law by President Obama includes provisions to address access for people with disabilities to medical diagnostic equipment. The "Patient Protection and Affordable Care Act" authorizes the Access Board to develop new access standards for medical diagnostic equipment including examination tables and chairs, weight scales, x-ray machines and other radiological equipment, and mammography equipment.
